泰国修改净资本规则,允许证券公司持有加密货币等数字资产

泰国证券交易委员会已经修订了其净资本规则,以加强证券公司和衍生品经纪商的流动性管理,支持泰国交易所激增的交易,并适应数字资产交易。

 

 

泰国证券交易所(SET)和泰国期货交易所(TFEX)的交易量近几周大幅增长,特别是美国大选后,SET交易额在一天内达到1660亿泰铢,TFEX的期货合约增加到每天100万。

这两个交易所今年的交易量较常规交易量增长了近3倍。

 

为了支持不断上升的交易量,泰国证券交易委员会修订了证券和衍生品经纪商的净资本(NC)规则,以增加紧急情况下的流动性管理,调整风险值以符合当前的市场条件,并支持数字业务。

 

修订后的NC规则有望帮助计划进入开放数字或加密货币交易等新业务的证券公司释放流动性。

 

一些证券公司已经就推出加密货币交易所咨询过泰国证券交易委员会。

 

在2020年6月17日与企业经营者和相关方的公开听证会结束后,泰国证券交易委员会调整了NC要求。

 

修订后的标准包括增加使用次级贷款,以取代在短期内证券或期货交易大幅增加时维持净资本资金,并根据承销证券担保业务的风险和投资债务工具的风险,调整现金应收账款的风险值。

 

这个新规定还将把数字资产计入资本基金。

 

据一位内部消息人士透露,泰国证券交易委员会目前维持最低7%的NC要求。其一项调查发现,所有证券公司的NC持有量平均为2045%,远远高于规定水平。

 

此外,泰国证券交易委员会将允许经营数字业务的证券公司能够持有各种形式的数字资产,如加密货币和其他数字资产,以这些数字资产的价值计算NC基金。但需要根据资产质量进行扣除。该消息人士称,数字资产对企业NC的最大可计算金额是资产价值的50%。

 

如果证券公司经营数字资产业务并为其客户存储数字资产,NC规则要求公司将超过1%的冷钱包资本资金(离线系统)和5%的客户资产存储在另一个系统(热钱包或在线系统)。

 

如果证券公司也经营数字资产业务,但不维护客户的数字资产,NC规则就要求股东权益超过50万泰铢。

 

The Securities and Exchange Commission of Thailand has revised its net capital rules to strengthen liquidity management for securities companies and derivatives brokers, to support the surge in trading on Thai exchanges and to accommodate digital asset trading.


Trading volumes on the Thai Stock Exchange (SET) and the Thai Futures Exchange (TFEX) have risen sharply in recent weeks, especially after the US election, when SET trading volume reached 166bn baht in one day and TFEX futures contracts increased to 1m a day.

Volumes on both exchanges have risen nearly threefold this year compared with regular volumes.


To support rising trading volumes, the Securities and Exchange Commission of Thailand has revised the net capital (NC) rules for securities and derivatives brokers to increase liquidity management in emergency situations, adjust value-at-risk to conform to current market conditions and support digital business.


The revised NC rules are expected to help unlock liquidity for securities firms planning to enter new businesses such as open digital or cryptocurrency trading.


Some securities firms have already consulted the Securities and Exchange Commission of Thailand about launching a cryptocurrency exchange.


Following a public hearing with business operators and interested parties on 17 June 2020, the SEC of Thailand adjusted the NC requirements.


The revised criteria include increasing the use of subprime loans to replace maintaining net capital funds in the short term when securities or futures trades increase substantially, and adjusting the value at risk of cash receivables based on the risks of underwriting securities and investing in debt instruments.


The new rules will also include digital assets in capital funds.


The SECURITIES and Exchange Commission of Thailand is maintaining the minimum NC requirement of 7% for now, according to an insider. One survey found that NC holdings at all securities firms averaged 2,045 per cent, well above the required level.


In addition, the Securities and Exchange Commission of Thailand will allow securities companies operating in digital businesses to hold various forms of digital assets, such as cryptocurrencies and other digital assets, and calculate the value of these digital assets for the NC fund. But it needs to be deducted according to asset quality. The maximum amount that can be calculated for a digital asset to a corporate NC is 50 percent of the asset's value, the source said.


If a securities firm operates a digital asset business and stores digital assets for its customers, the NC rules require the firm to store more than 1 percent of its cold wallet capital funds (offline system) and 5 percent of its customer assets in another system (hot wallet or online system).


If the securities firm also operates a digital asset business but does not maintain the client's digital assets, the NC rules require shareholders' equity of more than Bt500,000.
